Summary/Abstract: The content of the article focuses on the issue of cross-border provision of electronic evidence, which is a means of criminal procedural law of irreplaceable importance in the fight against several serious types of crime, such as crime related to interference with life or health of individuals, drug crime or corruption. criminal activity. The aim of the paper is to identify the basic legal framework for the cross-border provision of electronic evidence, especially with an emphasis on interception and recording of telecommunications traffic and to objectively evaluate the possibilities of securing digital evidence, both within the US and within the European Union (EU).
