Summary/Abstract: The long tradition of territorial military is reflected in the variety of arguments that justify it. Their multi-aspect nature does not raise any doubts. On the other hand, it is debatable to assess the practical implementation of the idea of the Territorial Defense Forces, especially in terms of the possibility of holding a TDF soldier to legal liability appropriate to the army (criminal or disciplinary). Due to the framework of this study (after indicating: a historical outline, selected reasons justifying the return to the tradition of local troops or determining the legal status of a TDF soldier), the issue of legal liability of an TDF soldier serving: rotational or on-site, was discussed on the example of his disposal (in arbitrary manner) with military property in the form of a uniform. The entire study was completed with conclusions and de lege ferenda proposals, the implementation of which is necessary to ensure uniform standards of the soldier's legal liability.
