The basis for determining the time of repairing a vehicle in the context of the reimbursement of the cost of a replacement vehicle rental

Summary/Abstract: Observations of the market reality indicate that despite the publication of the Financial Ombudsman’s report entitled “Supervisory Guidelines on Motor Claims” there are still numerous disputes between the aggrieved party and the insurance company. One area of controversy is the issue of reimbursement of the cost of hiring a replacement car. In particular, a significant research problem is the correct deter- mination of the time needed to repair the vehicle, where the direct economic dimension is perceived in the form of reimbursement of the replacement vehicle rental costs.Numerous discrepancies, both in the proceedings of insurance companies, court experts and the jurisprudence of courts, encouraged the authors to introduce the topics in terms of technological, organizational and real repair time definition. This article attempts to describe the differences resulting from the adoption of a replacement vehicle rental for the calculation and the cost of its reimbursement of variables defined as: technological, organizational and the actual vehicle repair time. For empirical purposes, a case study was used – a numerical experiment consisting in comparing these parameters with the actual expenditure of time needed to repair vehicles. All considerations have been supplemented with a conceptual approach to calculating the real time to repair a vehicle.The presented research results can find their practical application both in the work of insurance companies, court experts and representatives of legal professions representing individual parties to a court dispute. Bearing in mind that the available literature lacks interdisciplinary studies relating to the essence of technological, organizational and actual repair time definition in relation to the re- placement vehicle rental and its refund costs.
