Summary/Abstract: Attestation includes verification and assessment according to a system and criteria for the ability of employees to effectively perform their duties related to their official positions and to carry out activities assigned to them by law. Attestation assumes the role of a modern system for evaluating the performance of the position and is a necessary requirement for professional growth following the general principles and good administrative practices of the member states of the European Union. This resume aims to present the requirements and principles of assessment introduced by Decision № 465 of 09.07.2002 of the Council of Ministers, when the Strategy for the Modernization of the State Administration in the Republic of Bulgaria was adopted and the requirement to strengthen the prestige of the civil service in order to improve the effectiveness and the achievement of results in the public sectors after the accession to the European Union defined. A number of the judicial systems in Europe are examined – amongst which those of France, Spain, Italy, Finland, the Netherlands - all of which are connected to guiding principles such as power, efficiency, accountability, as well as legal systems for evaluating courts. Attention is drawn to the right to a fair trial as part of the principles of judicial evaluation in USA.
