Summary/Abstract: Espionage is certainly a topical area or activity, which we can claim to be present in many, if not in all areas of social activity. In this article, we will primarily be concerned with the presence of espionage as an illegal act in diplomacy. We will extend our analysis of espionage also to the field of intelligence services, as we have determined that the activities are complementary, intertwining and cooperative. We will focus on the function/ task of obtaining data and information. We are interested to research the relationship between diplomacy and the intelligence service of a particular country, the need and causes of spying and last but not least, the consequences of possible detection of spying. Both diplomacy and intelligence services are primarily established for the purpose of operations in and in relation to foreign countries, that is, in the international community. It is absolutely clear that a country as a sovereign entity in the modern world has no viability if it does not connect and does not cooperate with other countries. Integration and cooperation depends essentially on the interests of each country in the international community, which in most cases is an economic interest. To be able to regulate international conditions and relations with other countries, they need data and information to provide them the knowledge about how to successfully regulate and implement their interests in the international community.
