Summary/Abstract: The civil servant appears in the foreground of the administrative activity. His conduct, his attitude, his acts, the manner of communicating, of relating to the beneficiaries of the services that fall under the charge of the administration, all these and more outline the public image of one of the most important powers of the state, namely the executive. The civil servant is the main element in the composition of administrative bodies, bodies without which no form of social life can be conceived. Social life, by definition, requires administrative organization. The activity of the civil servant, the duties, the obligations, the powers with which he is invested, his rights are rigorously established and framed in the patterns of the law, or, we think, that is how it should be, practice also showing us contrary situations, consisting of deficiencies and slippages from what we call the quality of the law. That is why when we talk about legal liability in a field so important for the proper functioning of the administration, it is necessary to take into account the characteristic elements of this field of state activity, knowing that here too there are evolutions and changes imposed by progress and social dynamics
