Reduction of formalism in the Polish criminal process

Summary/Abstract: The purpose of this article is to examine the issue of formalism in the Polish criminal process, taking into account both its latest manifestations and the established practices of proced-ural authorities. The author also advocates legislative postulates, both in terms of direction and specific changes. Atheoretical analysis of the formalism issue is carried out, and its definition is formulated and at the same time the background of social legitimacy is included. Practical experi-ences related to the criminal process also play asignificant role. This issue is certainly of great importance, especially in functional terms, and it is the subject of interest for legislators consid-ering directions for changes in regulations related to the Polish criminal process
