Summary/Abstract: Article 101 and 102 of the Treaty on the Functioning of the European Union is the main way of punishing antitrust behavior and, therefore, the main legal instrument used to achieve the objectives in terms of fair competition. In this respect have spoken many times when European courts had to establish and later to strengthen their way of interpretation. Applying these rules requires knowledge of three aspects: the need to determine the behavior prohibited by antitrust law; interpretation of Community law must be made in order to prevent violations of the prohibitions of art. 101 and 102 TFEU; can not prevent the achievement of all antitrust behavior as the administrative bodies do not have all the resources needed to discover, investigate and punish.
