Summary/Abstract: The article introduces the recent case of Joseph Mpambara and the judgment of a Dutch court of 24 March 2009. According to the indictment Mr. Mbampara (a refugee in the Netherlands from Rwanda) has raped 4 women and cut their throats in a car, tortured a family and killed boys and women during the conflict in Rwanda. It goes on to underline that, though controversial, the principle of universal jurisdiction finds application in many countries, members of the European Union. The article analyses the legislation in Austria, Belgium and Germany as well as the case law in these countries. Belgium’s experience with the application of its universal jurisdiction law is a classical example of the inter- section of law and power in the international arena.
