Definition of legal risk in banking and critical assessment of recommendation H of Polish Financial Supervision Authority

Summary/Abstract: The subject of this article is an evaluation of part of recommendation H of Polish Financial Supervision Authority regarding legal risk. The author proves that the recommendation should be revised since legal risk as an element of operational risk grows and has an impact on stability of banking system. The author presents sources of recommendations system and stresses the need of improvements. Afterwards he introduces his own definition of legal risk; detailing and rationalizing its elements; adding economic meanings to raised issues. Next the author critically evaluates the only recommendation of PFSA regarding legal risk and finally indicates the structure of new recommendation to exhaust the scale and range of raised issues.
