Legal opinion on a Deputy serving on the board of a company operating with the use of EU funds

Summary/Abstract: According to the author, there are no legal obstacles for a Deputy to hold shares in certain types of companies which, in their business, benefit from EU funds. If funds for the implementation of the program in which the company intends to participate, come – partly or in whole – from the state budget, they will be classified as state property. There are reasons to consider that the funds available to entrepreneurs under EU programs, paid in 100% from EU funds, do not constitute property of the state nor municipal property.
