Autonomy of Churches and the Status of Religious Ministers in the Czech Republic

Summary/Abstract: The article discusses the legal conditions of church autonomy in the Czech Republic with a particular focus on the question of autonomous appointment and dismissal of religious ministers. The author uses the case law of higher-instance courts to conclude that questions of service of religious ministers are categorically excluded from judicial review. The only exception is the question of wage claims raised by religious ministers, in which the private law character of the Church as an employer becomes paramount. The principal thesis of the article is that church autonomy cannot be separated from the individual right to religious freedom because these are two sides of the same coin.
