Cancellation of penalty waiver and deferral. Incongruence in the practical application

Summary/Abstract: The article envisages a brief overview of new institutions introduced by the new Criminal Code come into force on February 1, 2014, namely: waiver of punishment and the postponement of legal punishment- from a dual perspective - Criminal Law / Criminal Procedure Law. Another aspect of the analysis concerns the institution of suspended sentence under supervision, which was redesigned by the legislator. Finally, they focus on the deficient regulation and the two new institutions that under certain assumptions can’t work, in spite of express provisions.
