The duration of the temporary suspension of enforcement in the execution appeal

Summary/Abstract: The temporary suspension of enforcement under Art. 719 par. 7 C. pr. civ. raises many interesting issues whose interest is even greater as it is not just the execution appeal but is, as stated High Court of Cassation and Justice, the common law relating to suspend the operation. One of these issues concerns the duration of this measure. Although legal practice occurred ruling opting for an opinion to the effect that the temporary suspension of enforcement effective and beyond when the court resolves appeal to execution resolve application for stay of execution, such optics is not justified by the current legal regulation.
