Summary/Abstract: It needs to be reminded at the beginning that, on principle, the decisions of medical courts do not constitute legal precedents in the Polish legal system. In other words, such decisions do not createa new legal standard solely being a practical interpretation of individual legal regulations. The situation is more complicated in the case of medical courts, due to the provisions of Article 76 of the Medical Code of Ethics which stipulates that, in the cases not regulated by this Code,the principles expressed in the decisions of medical courts should be followed. The opinions and arguments of the Supreme Medical Court seem significant, as this Court is an appellate courtagainst the decisions of regional medical courts, as provided in article 90 of the law of December 2, 2009 on medical chambers. This paper analyzes selected justifications of the decisions issued by the Supreme Medical Court in 2013.
