THE DELEGATION GIVEN TO A LEGAL ADVISER – THE WARRANT GIVEN TO A PROFESSIONAL

Summary/Abstract: The author presents a series of particularities of the legal adviser profession, taking note of the fact that, in Romania, this profession is regulated in conditions identical to those of the lawyer’s guild. This article contains relevant commentaries on procedural irregularities regarding warrants given to legal advisers for judicial defence, in light of Law no. 514/2013 on the organization and exercise of the legal adviser profession and of The Civil Procedure Code of Romania, with reference to past regulations. In closing, the author raises the problem of usage by the law-maker of the phrase “on the basis of the law”, which leads to serious difficulties with regard to knowing and interpreting regulatory acts in this field.
