Insurance fraud under the new Criminal Code

Summary/Abstract: In the present paper, I analysed the offense of insurance fraud as regulated by the new Criminal Code. For the purposes of this analysis, I considered the fundamental elements of the criminal offense, the previous laws, the procedural aspects specific to this offense, as well as some similarities and differences between the current regulation and the provisions of Article 215 of the Criminal Code of 1969. Moreover, in order to offer a vision as close as possible to the way the criminal provisions are applied, I constantly referenced recent judgements of the Romanian courts of justice. The novelty brought by the present paper is the analysis of new legal provisions with direct reference to recent case-law. The paper is useful to law students throughout the country, viewed through the analysis of this offense, as well as to practitioners in this field of law.
