On Some Issues of The Abbreviated Procedure

Summary/Abstract: The article discusses some issues of the abbreviated procedure as established in art. 370 – 374 of the Bulgarian Code of Criminal Procedure (CCP). This special procedure has two forms which are conceptually different. It is argued that only the one provided for in art. 371 (2) CCP can be characterized as a real special procedure. The preliminary hearing as part of the abbreviated procedure is critically examined. It is considered unnecessary because it has no added value and makes the procedure unduly complex. Art. 58a of the Criminal Codeis also analyzed and some problems with its interpretation and application are identified.
