Summary/Abstract: The presence of the informed consent is necessary in case when a patient is waiting for an important treatment. Yet there remains a question yet: whether the patient is signing the informed consent on the basis of free will or on the basis of necessity – as a matter of deadlock situation. We can hardly imagine someone really wanting to expose his or her body to surgery – there is no one who can guarantee treatment/surgery to run in full accordance to the expected results. The patient who can not influence the outcome of treatment has to agree to surgery and conditions, because he doesn’t have another option to cure illness and maybe to stay alive.The informed consent doesn’t comply with some provisions of law, that’s why there is a reason to doubt in considering mentioned documents as a deal.
