Summary/Abstract: The commentary concerns the possibility of recognizing the terminal severe illness as a negative prerequisite for criminal proceedings. The author shares the view of the Supreme Court that such a disease is not a circumstance of this nature but for other reasons than indicated by the Supreme Court. He also states that the grounds for suspension of legal proceedings cannot be only real obstacles.
