Summary/Abstract: The preconditions for the application of the institute of the suspended sentence under Bulgarian Criminal Law are specifically provided for in Article 66 (1) of the Criminal Code. The fact that they are provided by the law in the criminal legislation after 1904 gives the possibility to study the issue in which cases it is justified to postpone the execution of the imposed punishment. The clarification of the preconditions for the application of the said institute has great significance both to define its place in the State criminal policy and to increase its efficiency. It imposes clarification of the issue regarding the preconditions for the application of suspended sentence. The present study is dedicated to one of the preconditions for suspended sentence namely the type and the size of the imposed punishment to the convicted person.
