Summary/Abstract: In article it is specified, that slow acceptance of standard legal certificates of counteraction to illegal encroachments on cultural values is one of problems. The author defines the primary goals of the legislation of Ukraine about protection of an archaeological heritage. The basic problems in sphere of protection cultural, in particular an archaeological heritage of Ukraine are defined: insufficient study of the earths on which there are archaeological monuments; the insufficient control over preservation of monuments from authorities that leads to cases of their destruction; absence of scientifically proved methodical recommendations concerning investigation of criminal offences in sphere of the reference of cultural values.
