Summary/Abstract: In compliance with the EU Directive 2000/31/EC, the Serbian Act on Electronic Commerce (2009) explicitly lays down the limitations on the liability of intermediary service providers who offer mere conduit, caching and hosting. These provisions have been sufficient until recently. However, the advent of Web 2.0 has enabled a mass of new services and possibilities on the Internet. Users can easily upload online content that can be accessed, viewed and downloaded by other users around the globe.Certainly, some of these files include unlawful content: music videos that infringe upon copyright law, films that show pornography, music with defamatory texts, hate speech, etc. In this paper, the author explores the extent of liability of platforms that support UGC for unlawful content posted by users and discusses the need for a more contemporary regulation in this field. Citing various researched case studies and legal cases, the author highlights possible risks where traditional legal rules maybe inadequate to address certain types of online activity, and discusses many legal challenges which this new frontier brings
