THE NOTION, CHARACTERISTICS AND CONTENT OF OBLIVION IN CRIMINAL LAW

Summary/Abstract: The amnesty is the old act in the from of law with which to the undetermined number of persons is given the divestment of the criminal persecution,complete or partial divestment of the punishment execution, the sentenced punishment is replaced with the smoother one, is given the rehabilitation or repealed some or all legal consequences of the sentence or are repealed the safety measures: the prohibition of making the phone calls, activities and duties, the prohibition of driving the motor vehicle and the deportation of the foreigner from the country (the article 109.Criminal code of the Republic of Serbia). In this paper the author has analysed a notion, characteristics of amnesty in Serbian and comparative criminal law.
