QUESTIONS ON THE MEDICAL MALPRACTICE IN THE JURISDICTION AND THE THEORY. CONTRIBUTIONS TO THE RESOLVING THE PROBLEMS OF MEDICAL DELICTS

Summary/Abstract: The article considers the jurisdicition of the Bulgarian courts about the questions of torts and tort liability on the field of medical malpractice. The object of the article are cases, which were not shown to the public. The author has made conclusions on the basis of opinions of the jurisdiction, that has found their places in the decisions. There is publicated statistic about our and other countries. The greates contribution of the article are the analisis of the specific moments in the liability for medical practice and the many projects of decisions by resolving cases by the courts.
