Summary/Abstract: The civil servant's legal relation of employment (service) consists of the act of appointment, which is an administrative act. The civil servant is an agent of the publicpower which he exercises within the limits of his office. The regulation results from theconstitutional norms of Law no. 188/1999, being completed with the norms of employmentlaw, insofar as they do not contravene the specific legislation of the civil service. The legalnature of the civil servant's employment relationship is an object of doctrinal controversyover his contractual or legal nature, this being clarified by the case law through Decision no.14/2008 High Court of Cassation and Justice.
