Summary/Abstract: This article deals with the problems related to the definition and explicit positivation of a possible human right to democracy. Against the background of minimalist political projects aimed at outlining a narrow bundle of human rights, and of wider moral projects where the conception of human rights includes also an adequate form of political participation, the crucial role is stressed of the principle of equality in the relevant decisions concerning such a right. The analysis of the internal logic of democracy and of rights, as well as of the interaction between them, leads to the conclusion that there is a need for a ‘cautious’ interpretation of the right to democracy as an implicit possibility rather as an explicit norm of the political order.
