Summary/Abstract: The disinheritance represents a total or partial withdrawal of the right to compulsory portion from a heir entitled to portion of inheritance, made against the testator's will undoubtedly declared in the testament, due to the reasons stated by the law.This institution was primarily discussed in the paper through the prism of the Law of Inheritance of the Republic of Serbia enacted in 1995. The solutions offered by the Law were analyzed concerning the regulation of the institution of disinheritance. Advantages and disadvantages of these stipulations were pointed out, as well as their similarities and differences with regard to the regulations of this institution defined in the Law of Inheritance of the Republic of Montenegro.
