Summary/Abstract: The paper discusses the practice of balancing conflicting interests in the implementation of the Law on Free Access to the Information of Public Importance. A comparison between legal provisions and their practical application reveals that requests for information are mostly decided in an arbitrary manner, without much support in the letter of the law. This deficiency has been inherent to the procedures conduct ed before first-instance authorities and the Commissioner for the free access to information of public importance throughout the implemen tation period of the Law. Aiming to contribute to the elimination of this legal flaw, the finishing part of the paper provides the proposals of how the relevant statutory provisions on balancing conflicting interests may be amended and thus, potentially, help the practice of their lawful implementation be established in future.
