Summary/Abstract: The distinction between preemption and prevention is not only a conceptual one. Although, the question of legitimacy is a decisive vector which attract states in the decision making process. Whether to act or not, is becoming a strategy of a power politics in the battle against terrorism. The balance will incline on the one who will get the Intell first, whenever will be a state or a terrorist group. The right to act resides only to the one that is legitimate in its action. The question is if the legal norms will evolve toward legitimacy or will remain immutable?
