Summary/Abstract: Bulgarian spatial planning is submitted to complex of rules. They are contained in varied acts – laws, regulations, schemes and plans. According to Bulgarian legislation, all types of constriction are allowed provided that they are permitted and are in compliance with the requirements of the Spatial Planning Act, its regulations, the provision of the specific land development plans and when the corresponding right in rem exists. The arrangement of the matter of illegal building itself means that this is social appearance with a lasting character and it should be created legal organization which will regulate the relative relations. Illegal might be an entire construction, an entire site or a part of it. Illegal is as well a site which has been built without an agreement by the National Institute of Immovable Cultural Heritage or by the corresponding municipality when it is referred to some protected territories which are related to protection of the cultural heritage according to the rules of the Law for the cultural Heritage. This is referred to immovable cultural monuments and for constructions in their borders and protected zones. The laws for spatial planning together with the arrangement of illegal building create rules as well and for organization of the results of this occurrence.
