Out-of-court Disposals in England and Wales

Summary/Abstract: The article “Out-of-court disposals in England and Wales” is dealing with alternatives to criminal procedure. Various out-of-court disposals applicable to adult as well as to youth offenders, namely informal warnings, community resolutions, penalty notices, cautions, conditional cautions, youth cautions and youth conditional cautions are described in terms of their history, conditions under which they apply and for which offences they are suitable. They are compared, their purpose is mentioned and the links to respective legislation and guidance documents are given. A short introduction presents out-of-court disposals and specific types of criminal procedure in the Czech law.
