Summary/Abstract: The purpose of this article is to comment the judgment of the European Court of Justice in case BTA Baltic Insurance Company v “Baltijas Apdrošin šanas Nams” AS (C 648/16). The judgment addresses whether the concept of the “use of vehicle” includes an accident involving two vehicles parked in a car park. The author considers the judgment in the light of Polish Supreme Court and Czech Republic jurisprudence. In the point of author’s view – the arguments presented by CJEU should be fully approved as they ensure that victims of the accidents caused by vehicles receive full protection and comparable treatment irrespective of where the accident in the EU occurred.
