Summary/Abstract: The constitutional referendum that took place in Turkey on 16 April 2017 was marked by the instrumentalisation of the popular will. In fact, the referendum procedure reflected a double instrumentalisation: the abuse of referendum seen as a democratic tool and the abusive modification of the Constitution from the point of view of circumstances and of substance. The military coup attempt of 15 July 2016 by the "former allies" gave the government Parry of justice and development (AKP) and the President of the Republic "the opportunity to build the infrastructure of a personalised regime". However, the referendum of 16 April 2017 has equally been the occasion to create a "constitutional sensitivity" within civil society. In brief, as the suppression of political-constitutional acquis under the state of emergency were not being legitimate, the efforts destined to reestablish the parliamentary regime werelegitimate themselves.
