Summary/Abstract: Directive (EU) 2019/1023 aims to determine the Member States to properly adapt their internal rules by establishing preventive restructuring frameworks, granting a second chance to honest debtors and taking measures to increase the efficiency of restructuring and insolvency procedures and discharge of debt. By transposing the principles set out in the Directive, the differences in the legal regime between national laws will diminish, which will contribute to limiting the phenomenon of forum shopping.
