Legal Professional Privilege under Polish competition law

Summary/Abstract: This article presents the issue of applying the principle of Legal Professional Privilege under Polish competition law. The above-mentioned principle has been developed on the basis of applying the regulations of EU competition law. Polish Competition Law Act does not lay down a separate provision in this regard. Instead, it contains a mere reference to the application of relevant regulations of article 225 of the Code of Criminal Procedure concerning the protection of officials’ and defense counsels’ secrets. The author of the article notes the necessity of separately regulating this principle under Polish competition law.
