Justifications of judgments in civil proceedings after the amendments introduced by the Act of July 4th 2019 amending the Code of Civil Procedure and some other acts

Summary/Abstract: The amendment to the Code of Civil Procedure, made by the Act of July 4, 2019 amending the Act – Code of Civil Procedure and certain other acts, introduced many changes to the Polish civil procedure, which were mainly aimed at accelerating court proceedings. This objective is also served by changes in the principles governing the reasons for the judgment, which aim to reduce their number and scale. The modifications aimed at achieving this objective are: the introduction of fee for an application for reasons for judgment, the reduction of the content of the reasons for judgment by introducing the obligation to indicate within the application whether it refers to the whole or the part of a judgment, the introduction of the possibility to prepare shortened (simplified) reasons for judgment in certain types of cases and the limitation of the requirement to prepare reasons without a party’s application. The article attempts to encompass the rules of preparing reasons for the judgment after the introduced amendment, accepting the general direction of modifications.
