Summary/Abstract: In a context in which, today, millions of consumers rate and review goods and services online and rely, in turn, on ratings and reviews made by other consumers online, finding them valuable in their decision making to buy a product or resort to a company's services, in November 2019, the EU Council adopted a new directive, EU Directive 2019/2161 amending four directives on consumer protection, and setting forth provisions on this issue. From now on, companies shall manage reviews and ratings online in order to protect their reputation, but also to avoid misleading consumers and to ensure compliance with the „truth in advertising” regulations that impose on them new duties of transparency and loyalty.The article below contains a proposal for systematization of the potential unfair business practices regarding online reviews and ratings and of the legal remedies at hand, from the perspective of the provisions of EU Directive 2019/2161, in conjunction with the OECD recommendations under The Good Practice Guide on Online Consumer Ratings and Reviews of September 2019 and with the Guidance on the Implementation/Application of Directive 2005/29/EC on Unfair Commercial Practices of 2016.
