Summary/Abstract: The right of association is one of the fundamental, inalienable and imprescriptible human rights, provided in numerous documents such as the Universal Declaration of Human Rights (art. 20), the International Covenant on Civil and Political Rights, the Romanian Constitution. The latter regulates, in Article 37, the right of citizens to freely associate in political parties, trade unions and other forms of association. For the purposes of these provisions, the association may have as its basis either the exercise of a fundamental constitutional right - association in political parties or trade unions, or the association contract based on the principle of contractual freedom and binding force of contract (art. 1270 Civil Code), which establishes associations and companies under private law. Thus, based on these regulations, the civil society contract is concluded, which represents one of those institutions of civil law whose topicality cannot be challenged or minimized today, given the increasing share of the private sector in the market economy.
