Child Protection Act and the Development of the Special Competence of Children

Summary/Abstract: The recently adopted Child Protection Act provides for many new and unfamiliar to the Bulgarian legal tradition provisions. Widening the opportunity for the child to be heart in the court and administrative proceedings with the relevant guarantees is one of them. The article is an attempt one of the provisions of the Act – article 15 “Participation to Proceedings” to be interpreted in its connection with both the Family Code and Civil Procedure Code. Analysis is focused on the child participation, age limitations, test for majority for children beneath the age of 10, right to appeal and special representation of the child. The research shows that the Act despite its innovative and liberal nature needs further development. It becomes also evident that both the Family Code and Civil Procedure Code need changes in line with the spirit of the Child Protection Act. The purpose is make all the procedure more child focused and child friendly.
