Summary/Abstract: In the Polish legal system, risk of incapacity for work is subject to protection under the Constitution itself. The definition of said risk and the scope of its regulation under the Constitution were determined chiefly by political as well as socio-economic context in which the Constitution was adopted. The present article briefly discusses the conditions that determined the shape of the constitutional right to social security as well as its content and significance for the legislative changes covering the risk of incapacity for work.
