Summary/Abstract: In the Sejm’s position on the constitutional complaint it was stated that the provisions of the Code of Civil Procedure Act are constitutional to the extent in which they make the appointment of an ex officio representative dependent on the determination by the court referendary or the court of the need for such an appointment, grant the court referendary the right to rule on the appointment of an ex officio representative, and to the extent in which they recognise the court examining the complaint against the decision of the court referendary as the court of second instance.
