Summary/Abstract: The article is a favorable comment on a recent public procurement case law of Bucharest Court of Appeal in two judgements where the successful bidder submitted test reports issued by conformity assessment bodies. Shortly, these reports were in breach of transparency principle regarding the technical specifications included in the tender documents, as a fundamental principle of public procurement law.
