Summary/Abstract: The article deals with the following topics: the occurrence law, the documents intended to initiate the procedure, the material and functional competence of the court, the holders of the court referral in order to take the measure of provisional detention, the procedure before the court, the criteria according to which the court decides on the referral, the duration of provisional detention, the nature of the judgment given, and also the nature of the way of appeal against it.
