Summary/Abstract: The standard of proof regarding the subjective component of the crime committed by a moral personal, the qualification of the guilt as intent, negligence or oblique intent have had an interesting evolution. Regardless of the system of law it developed in, legal or jurisprudential, the standard of proof has always been a guarantee of due process in criminal matters. The conclusions of the two branches of evolution regarding the standard of proof reveal the similarities on the evaluation of guilt, generating a uniform application of law, without discrimination, regardless of the place where the crime took place.
