Summary/Abstract: This article deals with the definition of the war and the armed conflict in contemporary international law, which includes the prohibition of the use or threat of armed force in international relations. Since 1945 the use of armed force by states does not meet criteria typical for wars in the past and there is no development in redefining of the war. Today´s international law uses the term armed conflict for situations of armed violence in the world and is based on the division of the armed conflicts in two categories: international armed conflicts and non-international armed conflicts. Further, the article pays attention on some actual problems arising from this division.
