Summary/Abstract: Legally and in accordance with criminalistic rules the conduct of criminalistic authorities in accordance with the powers implies the simultaneous existence of a material precondition and a formal basis for action. The material precondition for criminal conduct is a certain factual situation, subject to appropriate legal provisions, which make certain the need and possibility to take measures and actions to prevent, detect, illuminate and prove the crime, ie to find and deprive of freedom its perpetrator. Basically, it can be twofold, to indicate the existence of facts and circumstances that only suggest the existence of a criminal offense prosecuted ex officio and its perpetrator, as well as the existence of suspicion corroborated by evidence that a crime was committed or that a person committed a crime.
