Summary/Abstract: The paper by Silvio Boterò Giraldo, the professor of the Academy of St. Alfonsus in Rome, takes into account the problem of marital love as a fundamental element and the very goal of marriage. This is a matter of much of controversy in the history of the theology of marriage, as well as – or even more – in canonical law. The author focuses on three main subjects: a historical synthesis of the presence of idea of love in the theology of marriage; the acceptance – after some initial reluctance – of marital love by the Second Vatican Council; and a place of three main (for the post-Vatican teaching) ideas: a central place of the idea of human person, the principle “salus animarum” as a “highest Church’s law” and a proposal to verify “favor iuris” into the privilege of the dignity of human person.
