Summary/Abstract: The declaring in March 2020 by the World Health Organization of the COVID-19 epidemic as a pandemic, determined the Romanian legislator and the central authorities to proceed to adopt normative acts that, in a convergent way, would contribute to limiting or preventing the spread of the SARS-CoV-2 virus. The sanitary measures were completed with the amendment of the texts that incriminate the crime of thwarting the fight against diseases provided by art. 352 of the Criminal Code, as a means of criminal law intended to prevent, fight and sanction the acts that infringe the social value protected by the criminal law: public health.
