Summary/Abstract: The subject of the study is the possibility of running for the body constituting the court by people who do not live in the area of a given city and the assessment of its compatibility with the Constitution of the Republic of Poland. Such a solution was presented in the course of work on the latest amendments to the electoral law (print Sejm no. 2001, term of office VIII). It predicted, inter alia, allowing candidates with passive electoral rights to run for all organs in the area of the voivodeship in which he / she lives habitually (cf. the proposed text of the law of Article 11 § 1 point 5).
